2012 shipped semen contract
The stud fee and the shipping fees must be paid in full before the shipment is made. The 2012 shipped semen fee for is $200.00 for collection and $100.00 FedEx fee. If a Saturday shipment is needed, FedEx chages $50 more. *Please make check payable to Karan Walsh*
If you have a FedEx account, you may use it, and it may save you money. But Haygood Paints must have your account number before shipment is made or payment for shipping, before shipment is made. If this is a breeding bought from a SSA, a $100 chut fee may apply (call). Normal collection schedule is 9:00 a.m. to 1:00 p.m. Monday though Friday PST. Check with FedEx (800-463-3339) to see if you live in a remote shipping location, and to whither or not you can receive guarantee Saturday delivery. Send back all containers. If we need to re-ship to you, we will us the same container and not charge you for a new one. But if we do not have it back, you will have to pay $35 for a new container. That includes all cost to get semen from Haygood Paints to the mare owner.
It is strongly recommended that a veterinarian examines the mare, and deems her breeding sound. All parties agree that the semen shipped under this contract is to be used only for inseminating the same said mare as in the breeding contract.
Semen is shipped on a first come first serve basis.
All semen request must be called in by 10:00 a.m. PST for shipping the following day. Example, the veterinarian tells you to have the semen at the office Friday. Haygood Paints will need to be notified by phone on Wednesday to have your semen there on time. The mare owner shall assume the risk and expense associated with a lost or delayed shipment and shall not hold Haygood Paints responsible.
Should the mare not settle after three (3) shipments, the mare owner may use a substitute mare, with Haygood Paints approval. Haygood Paints must have all of the new mare's information before shipping. Regardless whether additional shipments are made for inseminating the original mare or for the substitute mare, the charges for each shipment made, including shipping and handling will be the responsibility of the mare owner.
This contract shall not be assigned or transferred.
Signing of this contract by the mare owner so deems that the contract has been read, understood, and agreed to in all terms stated within. It is also agreed that in the event of any legal action resulting from this contract, mare owner shall be solely responsible for all-legal fees and costs of Haygood Paints and its owners or agents. This contract represents the entire agreement between the two parties. No other agreement or promises, verbal or implied, are included unless specifically stated within these written contracts (breeding and shipped semen). This contract shale be interpreted under the laws of California and any dispute for which legal action is pursued relating to this contract shall be filed in the county of Madera, CA.
